investigation into the release of convicted Pan Am Flight 103 bomber Abdelbeset al Megrahi has found the medical prognosis used to justify his release from a Scottish prison "was inaccurate and unsupported by medical science," according to a U.S. Senate report released Tuesday.
The release of the report, led by Sen. Robert Menendez, D-New Jersey, coincided with the 22nd anniversary of the bombing, which occurred over Lockerbie, Scotland, in December 1988, killing 259 people aboard the Boeing 747 and 11 on the ground.
Al Megrahi was released from a Scottish prison last year on the grounds that he had cancer and was not likely to live more than three more months -- a prognosis Menendez has questioned.
The report, titled "Justice Undone: The Release of the Lockerbie Bomber," was the result of a five-month investigation led by Menendez's office and was co-signed by Sens. Frank Lautenberg, D-New Jersey, Kirsten Gillibrand, D-New York, and Charles Schumer, D-New York.
It is based on interviews with officials from the United Kingdom, Scotland and the United States, including "substantive experts" within the U.S. State and Justice departments. Also interviewed were U.S. and British prostate cancer specialists, "academic experts on Libya and energy policy, and business executives with operations in Libya," the report says.
"The three-month prognosis given to al Megrahi by Scottish doctors was inaccurate and unsupported by medical science," the report said.
The report also took issue with the Scottish government's decision to grant al Megrahi compassionate release, indicating the process was determined by general practitioners without expertise in prostate cancer who were "clearly involved in political, inter-governmental discussions."
"In view of the flawed process, we believe that the Scottish government simply intended to use compassionate release as political cover for returning al Megrahi to Libya -- regardless of whether his physical condition met the requirements," the report said.
Menendez, a Democrat, said he undertook the investigation after British and Scottish officials refused to testify at a Senate Committee on Foreign Relations hearing he was scheduled to chair in July.
"Instead of living three months, he's lived 13 months and counting," Menendez said in a September committee hearing on the matter.
At the hearing, Menendez questioned what he characterized as contradictory medical information from the Scottish government.
He played a videotape that showed al Megrahi walking up a flight of stairs to board a plane to Libya after his prison release, despite allegedly being near death.
A State Department official testified that commercial concerns may have influenced Scottish consideration of al Megrahi's release.
"There were political, security and economic considerations that were involved in the decision making," said Nancy McEldowney, the deputy assistant secretary of European affairs at the State Department.
The report expanded on that allegation, saying "the threat of commercial warfare was a motivating factor."
"The U.K. knew that in order to maintain trade relations with Libya, it had to give in to political demands," the report said.
McEldowney said the United States never supported the decision of releasing al Megrahi.
Menendez said he asked representatives from oil giant BP to testify at the hearing regarding allegations that the British company urged the Scottish government to release al Megrahi in exchange for a multimillion-dollar oil deal with Libya. No one from BP would testify, Menendez said.
Al Megrahi was the only person convicted in the bombing. Most of the victims were Americans. The flight was heading to New York from Frankfurt, Germany, via London, England, when it blew up.
A special Scottish court in the Netherlands convicted al Megrahi in 2001. Released in August 2009 after serving eight years of his life sentence, he returned to Libya.

A federal jury has convicted a former street preacher of kidnapping Elizabeth Smart more than eight years ago.
The verdict reached Friday finally brought justice for Smart and her family after the ordeal that began when Brian David Mitchell took her from her home at knifepoint and held her captive for nine months when she was 14.
Now 23, Smart testified during the five-week trial that she was forced into a polygamous marriage and endured near daily rapes.
The jury found Mitchell guilty of kidnapping and unlawful transportation of a minor across state lines for the purposes of illegal sex. It rejected the defense argument that he was not guilty by reason of insanity.
Each charge carries a maximum penalty of life in prison.
'Predatory chameleon'
During the trial, Mitchell was removed daily from the courtroom for singing hymns and disrupting proceedings. Last week, he had a seizure in the holding room where he watches the trial on television. He spent several hours at a hospital before being returned to a jail.
Prosecutors say the 57-year-old is faking mental illness to avoid prosecution.
"He's a predatory chameleon with the cunning to adapt his behavior to serve his needs and desires at any given moment," Assistant U.S. Attorney Diana Hagen said during an 80-minute closing argument.
Hagen told jurors that Mitchell acted deliberately when he took Smart from her home at knifepoint in the middle of the night and threatened her life if she cried out for help. Mitchell was also deliberate when he forced Smart into a polygamous marriage, raped her daily and held her captive for nine months, hiding her behind long robes, a head scarf and veil, and a religious name.

"He stripped her of her clothes, her identity and her innocence," Hagen said.
Hagen said Mitchell didn't eschew mainstream society and live on the streets in the mid-1990s because of either a command from God or because a mental illness, but because he wanted to avoid work, child support payments and income taxes.
He chose when to follow his so-called revelations from God, Hagen said.
"If he chose those ideas then he can certainly choose to conform his conduct to the demands of the law," she said. "He can certainly choose not to rip a child away from her home and family, to rape and abuse her, to keep her bound like an animal, to rob her of her identity, her dignity and her childhood."
Steele disputed that Mitchell could shape his behavior to conform, since he had the delusional belief that he was above everyone else. It was a delusion that drove him to break laws starting at age 16, when he was convicted of exposing himself to an 8-year-old girl.
"It's easy to say that he's just making it up," Steele said during his hourlong closing argument. "But this is sustained, a long-term drive. He thinks he is special. This is not an overnight thing."
Outside the courthouse Steele said Mitchell was waiting for the verdict in the holding cell where he watches court proceedings each day.
"He's pretty indifferent to what is going on," Steele said.
Now 23, Smart has testified that she was forced into a polygamous marriage with Mitchell after the abduction, held prisoner on a tether and forced to endure nearly daily rapes. She also said Mitchell forced her to wear hand-sewn, religious-looking robes, to use drugs and alcohol, view pornography and to go to California against her will.
Smart has attended the trial, taking a break from serving a religious mission for The Church of Jesus Christ of Latter-day Saints in Paris.
Mitchell's estranged wife, Wanda Barzee, pleaded guilty to Smart's kidnapping last year and is serving 15 years in federal prison.

The jury found Mitchell guilty of kidnapping and unlawful transportation of a minor across state lines for the purposes of illegal sex. It rejected the defense argument that he was not guilty by reason of insanity.
Each charge carries a maximum penalty of life in prison.
'Predatory chameleon'
During the trial, Mitchell was removed daily from the courtroom for singing hymns and disrupting proceedings. Last week, he had a seizure in the holding room where he watches the trial on television. He spent several hours at a hospital before being returned to a jail.
Prosecutors say the 57-year-old is faking mental illness to avoid prosecution.
"He's a predatory chameleon with the cunning to adapt his behavior to serve his needs and desires at any given moment," Assistant U.S. Attorney Diana Hagen said during an 80-minute closing argument.
Hagen told jurors that Mitchell acted deliberately when he took Smart from her home at knifepoint in the middle of the night and threatened her life if she cried out for help. Mitchell was also deliberate when he forced Smart into a polygamous marriage, raped her daily and held her captive for nine months, hiding her behind long robes, a head scarf and veil, and a religious name.

"He stripped her of her clothes, her identity and her innocence," Hagen said.
Hagen said Mitchell didn't eschew mainstream society and live on the streets in the mid-1990s because of either a command from God or because a mental illness, but because he wanted to avoid work, child support payments and income taxes.
He chose when to follow his so-called revelations from God, Hagen said.
"If he chose those ideas then he can certainly choose to conform his conduct to the demands of the law," she said. "He can certainly choose not to rip a child away from her home and family, to rape and abuse her, to keep her bound like an animal, to rob her of her identity, her dignity and her childhood."
Steele disputed that Mitchell could shape his behavior to conform, since he had the delusional belief that he was above everyone else. It was a delusion that drove him to break laws starting at age 16, when he was convicted of exposing himself to an 8-year-old girl.
"It's easy to say that he's just making it up," Steele said during his hourlong closing argument. "But this is sustained, a long-term drive. He thinks he is special. This is not an overnight thing."
Outside the courthouse Steele said Mitchell was waiting for the verdict in the holding cell where he watches court proceedings each day.
"He's pretty indifferent to what is going on," Steele said.
Now 23, Smart has testified that she was forced into a polygamous marriage with Mitchell after the abduction, held prisoner on a tether and forced to endure nearly daily rapes. She also said Mitchell forced her to wear hand-sewn, religious-looking robes, to use drugs and alcohol, view pornography and to go to California against her will.
Smart has attended the trial, taking a break from serving a religious mission for The Church of Jesus Christ of Latter-day Saints in Paris.
Mitchell's estranged wife, Wanda Barzee, pleaded guilty to Smart's kidnapping last year and is serving 15 years in federal prison.

He surrendered to police after Sweden issued a warrant for his arrest over allegations of sex crimes. The detention of Assange buys the U.S. Justice Department a little time as it scrambles to find a crime to charge him on.
It was a mob scene outside of the London court. Several celebrities came forward on Assange's behalf today, and his attorney issued this blunt warning.

First his potential exposure in Sweden or I guess in London for the events in Sweden about sexual assaults that are alleged. Second, the events relating to the leaking and the publication of the diplomatic documents. How do you assess his legal exposure?
JEFFREY TOOBIN, CNN LEGAL ANALYST: Well, I think he is in big trouble in both realms. The Swedish government has now filed formal charges against him and are seeking his extradition. Most of the time, extradition is successful. And it is likely, I think, that he will go back into Sweden sooner or later. Delay, of course, is always possible.
In terms of the WikiLeaks case, the case about disclosure of classified information, there have been no charges yet. But when you have the attorney general of the United States hold a press conference, the sole purpose of which is to say we are investigating this guy and his group for criminal activity, it's a safe bet the charges will be filed soon, and I think they will be.
PARKER: What's so hard about just charging him with receiving stolen government documents?
TOOBIN: Because you have to put the pieces together for a criminal case. Who actually just got these documents? How did they get on to WikiLeaks, on to the Web site? Who physically put them there? What was Assange's role in getting -- was it a thumb drive from point A to point B? All of that may be known to the U.S. government. It's certainly not known to the public now, and you can't bring a criminal case unless you can actually connect the evidentiary dots.

US embassy cables reveal top executive's claims that company 'knows everything' about key decisions in oil-rich Niger Delta
The oil giant Shell claimed it has inserted its staff into all key ministries of the Nigerian government, giving it access to politicians' every move in the oil-rich Niger Delta, according to a leaked US diplomatic cable.
The company's top executive in Nigeria told US diplomats that Shell had seconded employees to every relevant department and so knew "everything that was being done in those ministries". She boasted that the Nigerian government had "forgotten" about the extent of Shell's infiltration and were unaware of how much the company knew about its deliberations.
The cache of secret dispatches from Washington's embassies in Africa also revealed that the Anglo-Dutch oil firm swapped intelligence with the US, in one case providing US diplomats with the names of Nigerian politicians it suspected of supporting militant activity and requesting information from the US on whether the militants had acquired anti-aircraft missiles.

The cable concludes with the observation that the oil executive had tended to be guarded in discussion with US officials. "Pickard has repeatedly told us she does not like to talk to USG (US government) officials because the USG is 'leaky'." She may be concerned that...bad news about Shell's Nigerian operations will leak out."

I believe that the Qatar World Cup will be a most effective weapon against al Qaeda and the forces of Islamist darkness. Arab society has seen the world embrace it in a truly global enterprise, and will, I believe, rise to the challenge—a challenge that includes not merely effective organization, but a transformation of traditional ways into cosmopolitan ones. Qatar will play host to tens of thousands of fans from around the world—men and women who will expect to sit together, women who will expect total equality and the right to dress as they please, fans who will want—and not expect to be denied—a drink…Fans who will have no truck with religious police, modesty police, or killjoys of any kind. And if Israel qualifies, Qatar will not be able to deny it the right to play, for the first time, on Arab soil. Think of that.
All this could be electrifying and transformative—the 2022 World Cup could, without exaggeration, bring about a cultural revolution.
Could be, although China’s a culture in need of a little revolutionizin’ too and the Beijing Olympics haven’t seemed to make much of a dent. There’s also a question, as there was with the South Africa Cup, of whether spending billions on soccer is the best investment a third-world country can make. Probably not an issue in this particular case, though: Thanks to black gold, Qatar boasts the second highest per capita income of any nation on earth and is promising to spend upwards of $50 billion(!) on infrastructure if need be to make things run smoothly. They’re also vowing to share the wealth with poorer countries — sort of:
Central to their bid was a revolutionary cooling system that would use solar power to provide zero-carbon air conditioning to cool the stadiums, technology that has the potential to transform the lives of tens of millions living near the equator.
And it is the legacy that a Middle Eastern World Cup could bring that has arguably persuaded FIFA to take a risk on Qatar. After the tournament, Qatar has promised to dismantle the modular stadiums and rebuild them in third world countries who can’t afford their own.

THE British lawyer for WikiLeaks founder Julian Assange said today that Interpol's pursuit of his client could be linked to the "bellicose" US reaction to the recent release of secret diplomatic cables.
Media lawyer Mark Stephens refused, however, to give the whereabouts of the 39-year-old Australian, for whom the global police agency issued a so-called "red notice" for questioning on suspicion of rape on behalf of Sweden.
"This is a persecution and not a prosecution," Mr Stephens said.
"We have no evidence pointing to a link between these allegations from August and the issue of the Interpol alert just two days after the WikiLeaks first release of US diplomatic cables," he said.
"However, it is highly unusual for a red notice warrant to be issued in relation to the allegations reported as having been made, since Swedish law does not require custodial orders in relation to the allegation."
He said it appeared to be a "unique action" by Swedish prosecutors.
Mr Stephens said: "We are also investigating whether the prosecutor's application to have Mr Assange held incommunicado without access to lawyers, visitors or other prisoners - again a unique request - is in any way linked to this matter (the WikiLeaks data release) and the recent, rather bellicose US statements of an intention to prosecute Mr Assange."
US Secretary of State Hillary Clinton accused WikiLeaks on Tuesday of an "attack on the international community" by releasing the vast trove of leaked US diplomat memos containing a string of embarrassing revelations.
Earlier this month Mr Stephens said that Mr Assange was in Britain, but he did not give details on where his client was now.
Separately, James Ball, a journalist working with WikiLeaks, said the site was suffering continued cyber attacks after an initial attempt to send it offline after the first release of the documents on Monday.
"The main thing we are having to deal with is the constant attacks on the servers. If you look, the site is down right now, we are working to get it back up," he said.
He said WikiLeaks did not know who was responsible, but added: "I know they (WikiLeaks) are logging all the addresses behind the attacks and are planning to publish them."
Mr Ball said he had been in touch with Mr Assange in recent days but did not know where he was.
"We don't know where he is. I think given the nature of what they are working on, it is not surprising that he is taking certain security precautions," Mr Ball said.
Sweden's International Public Prosecution Office in Gothenburg issued an arrest warrant for the secretive activist on November 18, citing "probable cause of suspected rape, sexual molestation and unlawful coercion".

Mr Stephens said: "We are also investigating whether the prosecutor's application to have Mr Assange held incommunicado without access to lawyers, visitors or other prisoners - again a unique request - is in any way linked to this matter (the WikiLeaks data release) and the recent, rather bellicose US statements of an intention to prosecute Mr Assange."
US Secretary of State Hillary Clinton accused WikiLeaks on Tuesday of an "attack on the international community" by releasing the vast trove of leaked US diplomat memos containing a string of embarrassing revelations.
Earlier this month Mr Stephens said that Mr Assange was in Britain, but he did not give details on where his client was now.
Separately, James Ball, a journalist working with WikiLeaks, said the site was suffering continued cyber attacks after an initial attempt to send it offline after the first release of the documents on Monday.
"The main thing we are having to deal with is the constant attacks on the servers. If you look, the site is down right now, we are working to get it back up," he said.
He said WikiLeaks did not know who was responsible, but added: "I know they (WikiLeaks) are logging all the addresses behind the attacks and are planning to publish them."
Mr Ball said he had been in touch with Mr Assange in recent days but did not know where he was.
"We don't know where he is. I think given the nature of what they are working on, it is not surprising that he is taking certain security precautions," Mr Ball said.
Sweden's International Public Prosecution Office in Gothenburg issued an arrest warrant for the secretive activist on November 18, citing "probable cause of suspected rape, sexual molestation and unlawful coercion".

There was a competition between a Japanese samurai and a Chinese Samurai.
First they took the Japanese Samurai into a room and told him there is a mosquito flying in this room and he has to hit the mosquito. The Japanese samurai listens for the buzzing of the mosquito and then suddenly whoosh with his sword. There is silence in the room and sure enough they find the mosquito cut in half on the floor.
Then they ask the Chinese Samurai that there is a mosquito flying in this room and he has to hit the mosquito with his sword. The chinese man listens for the buzzing from mosquito and then suddenly whoosh with his sword. There is silence in the room for few seconds and then the buzzing sounds start again. The Japanese Samurai jumps up and says he won because the mosquito is still alive. The Chinese man says the mosquito may be alive but no more babies.
